Evaluation of the Government Regulatory Impact Analysis of 2008

 Regulatory Impact Analysis(RIA) can be defined as a decision-making tool which analyzes impacts or effects of the newly introduced regulation, and aims to prevent bad and low quality regulation from being mass-produced unexpectedly. That's why most of OECD countries have adopted and operated RIA as a tool of regulatory reform, and Republic of Korea also legislated the Administrative Regulation Basic Law so that institutionalized RIA system.


Whether RIA system succeeds or not relies on making RIAs of good quality by using objective and scientific methods. However it has been pointed out that quality of RIAs of Korea government is still low. To enhance quality of RIAs, it is necessary to evaluate RIAs constantly, reflect evaluation results to relevant ministries and agencies, and correct the problems. In the year 2007 and 2008 the National Assembly Budget Office evaluated government RIAs and suggested the alternatives for RIA improvement and this year, also recommended some alternatives necessary for success of RIA.
 

Firstly, it is required to amend relevant provisions, so that all the regulatory bills be reviewed by the regulatory reform committee to prevent ministries from judging whether bills contain regulatory provisions on it's own.


Secondly, although it is mandatory by law for ministries to publish RIAs to the public in the time of legislation notice, most of ministries do not publish RIAs. So this report suggested the necessity of monitoring it by the regulatory reform committee.


Thirdly, it is necessary to organize the system, so that the regulatory reform committee asks ministries to supplement RIAs when the quality of RIA is considered to be low.
Fourthly, since very few regulations are subject to regulatory sunset provision, it is required to amend relevant laws and systems to adapt regulatory sunset provision, which bring about substantial effect.
Lastly, it is recommended not only to amend related law but also to establish a standing organization in the National Assembly that will carry out RIAs in the case that Assemblymen submit bills to the National Assembly.
