2013 Recommendations on Finance Law Improvements
The National Assembly Budget Office has issued the 「Recommendations on Finance Law Improvements」 report, which summarizes 24 items for revision on 21 finance-related laws, including the 「National Finance Act」, which were identified in the process of budget settlement analyses; national program evaluations; and investigations that were carried out in line with the regular sessions of the National Assembly for 2013.
As of the present, the National Assembly Budget Office has proposed a total of 102 recommendations on law improvements: 21 in 2008, 26 in 2009, 23 in 2011, and 32 in 2012 via the 「Recommendations on Finance Law Improvements」 reports. Among these recommendations, 22 have been submitted as bills, passed by the National Assembly, and been implemented.
This report is composed of a total of 24 recommendations: seven on the 「National Finance Act」, including the 'restriction on the establishment of funds other than the approved budget;' two on the 「Act on the Budgeting and Management of Subsidies」, including the 'prohibition on carrying forward the subsidies for two fiscal years by self-governing bodies'; and 15 on other finance laws, including the 'prohibition on carrying forward of tax expenditures without tax income sources.'
The key details include: ① In relation to the restriction on the establishment of funds other than the approved budget, a fund cannot be established by an individual law unless the name of the fund is included in the newly added appendix 4 of the 「National Finance Act」. ② In relation to implementing feasibility studies, feasibility studies should be performed for programs that have already been assessed by preliminary feasibility studies by the head of the central government. ③ Regulations on the targets of national subsidy programs and their subsidy rates cannot be stipulated elsewhere other than the 「Act on the Budgeting and Management of Subsidies」 for the integrated management of subsidies. ④ Prohibition on carrying forward subsidies for two fiscal years by self-governing bodies also needs to be stated in the 「Act on the Budgeting and Management of Subsidies」.
Out of the 24 recommendations made in this report, 15 items have been submitted for review as bills to the standing review committees, and nine items have not been submitted as bills.
